Introduction

The licensor, bitfly explorer gmbh, with registered company number FN 623067a, Wiedner Gürtel 9, 1100 Vienna, is the owner of all copyrights and/or other intellectual property rights to the subject matter of protection “BeaconScore” (referred to in the following as the “work”). “BeaconScore” is a metric developed by the licensor to measure the efficiency of blockchain validators. The licensor places the work under the licensing terms of the Creative Commons Attribution – Non-Commercial – ShareAlike 4.0 International Licence (CC BY-NC-SA 4.0), which is intended to enable worldwide and free use of “BeaconScore”. These Terms and Conditions of Use explain the content of this licence.

§ 1. Granting of the licence

(1) The licensor grants the licensees a worldwide, free-of-charge, non-sublicensable, non-exclusive and irrevocable right to use the work in accordance with the Creative Commons Licence CC BY-NC-SA 4.0 International. (2) The licence CC BY-NC-SA 4.0 grants the licensee the right to reproduce and redistribute the work in whole or in part in any format or medium exclusively for non-commercial purposes, with the work expressly attributed to the licensor. The licensee may also remix, modify and build upon the work (“derivative work”) under the conditions specified in section 2 (3).

§ 2. Terms of use

(1) Attribution (BY): The licensee shall be under an obligation to name the licensor as the creator by means of a clearly visible designation with the word “BeaconScore” each time that the work is used. The information must also include a reference to the licence used (CC BY-NC-SA 4.0) and a link or URL to the licensor’s BeaconScore documentation. The attribution applies to both the use of the original work and derivative works. (2) To comply with the requirements of section 2 (1) the licensee is required to follow the guidelines provided in the License Materials page. (3) Non-commercial (NC): The work or derivative work may only be used for non-commercial purposes. Non-commercial purposes include e.g.:
  • free-of-charge distribution in blockchain communities
  • use for internal presentations, analyses, training courses, workshops or for research purposes (e.g. citations in scientific articles, statistics, etc.)
  • use for non-commercial public relations activities (e.g. information brochures, awareness campaigns, publication on non-commercial websites)
  • use in white papers, blogs or YouTube videos with no revenue
(4) Any use of the work within the scope of services provided in return for payment or for generating a profit is excluded. This includes e.g.:
  • transfer of the work in whole or in part in return for payment
  • use of the work or parts of it as the main component of a commercial offering
  • derivation of products or services that are based directly on the work and are intended for further distribution in return for payment (“derivative works”)
  • use for commercial marketing purposes, in particular in advertising, product campaigns or other measures aimed directly at increasing sales revenues.
(5) ShareAlike (SA): Adaptations or transformations of the work or other derivative works may only be distributed under the same licence (CC BY-NC-SA 4.0 International) as the original work. Any distribution under different or more restrictive conditions is not permitted.

§ 3. Prohibition of additional restrictions

(1) The licensee is not entitled to apply technical protection measures or additional legal terms that would restrict the freedoms granted to third parties by this licence.

§ 4. Term of the licence and reservation of rights

(1) The licence granted will terminate automatically in the event of a breach of these terms of use. (2) In all other respects, the licensor reserves all rights not expressly granted by this licence.

§ 5. Applicable law

(1) Unless governed by the CC licence, Austrian law shall apply to these Terms and Conditions of Use.
